Ecording Environmental Technologies YAZ. MÜH. TİC. LTD. ŞTİ., hereinafter referred to as Ecording, has adopted the principle of protecting the privacy of visitors to the website www.ecording.org. Therefore, this privacy statement (“Privacy Statement”) explains what kind of information about users is collected by Ecording when using our website, how this information is used, and protected. IP address, name, surname, email address, and cookie records are collected by Ecording on the www.ecording.org website. Personal information submitted to us through our website will be used for the purposes stated in this policy or on the relevant pages of the site. We may use your personal information for the following purposes: to personalize our site for you, to provide services available on our site, to send you email notifications that you have specifically requested, to send you email notifications that you have specifically requested, to resolve complaints and requests made by you or related to you about our site, to keep our site secure and prevent fraud, to verify that our website and its terms and conditions are being complied with, and for other purposes. Under the Law on Protection of Personal Data No. 6698 (“LPPD”), your personal data will be processed by our Company, acting as the Data Controller, in accordance with the purposes described below, to be used, recorded, stored, updated, transferred, and/or classified, within the framework explained. In this context, our Company takes all necessary technical and administrative measures to ensure an appropriate level of security to prevent the unlawful processing, access, and safeguarding of your personal data, in order to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, and to ensure the protection of personal data, as required by the laws and regulations.

The target audience of this text is all natural persons whose personal data is processed by our Company, excluding our Company’s employees or employee candidates who have applied to our Company.

The personal data processed as a data controller is listed below, without being limited to the ones listed here;

Name, surname, email address, cookie records;

The purposes of processing personal data and the legal reasons;

Your personal data shared by you;

  • To benefit you and/or the institutions and organizations you represent from the products and services provided by our Company, to determine and implement the commercial and business strategies of our Company, to conduct marketing activities, to carry out business development and planning activities, including but not limited to these, to conduct necessary studies,
  • To conduct administrative operations related to communication carried out by our Company,
  • Establishment of business partner/customer/supplier (authorized or employees) relations,
  • Ensuring the fulfillment of contractual requirements and financial reconciliation related to products and services offered together with our business partners, suppliers, or other third parties,

  • To participate in the trainings, seminars, or events organized by our Company.

The method of collection and storage of personal data; Your personal data shared with our Company may be collected verbally, in writing, or electronically through offices, branches, websites, social media channels, mobile applications, and similar means, by automatic or non-automatic methods. Your personal data will be stored in electronic and/or physical environments. Necessary business processes and technical security infrastructure developments are implemented to ensure that the personal data obtained and stored by our Company are not subject to unauthorized access, manipulation, loss, or damage.

Your personal data will be processed by taking all necessary information security measures without being used for purposes and scope other than those notified to you, and will be stored and processed during the legal retention period or, if such a period is not foreseen, for the period required by the processing purpose. After this period, your personal data will be deleted, destroyed, or anonymized by our Company using deletion, destruction, or anonymization methods from our Company’s data flows.

Transfer of Personal Data;

  • Your personal data may be transferred to the persons authorized by us, companies acting on behalf of our Company, representatives;
  • Regulatory and supervisory institutions, public institutions or organizations that are clearly authorized to request personal data by the laws in force,
  • Tax and similar consultants, compulsory persons, institutions, and organizations related to legal follow-up processes, and third parties, including but not limited to consultants, including auditors, within the scope of the purposes specified above, domestically and abroad.

Your rights under Article 11 of the LPPD;

By applying to our Company, your personal data;

  7. Requesting notification of transactions made pursuant to subparagraphs (e) and (f) to third parties to whom personal data are transferred,
  8. Objecting to the occurrence of a result against you due to analysis by exclusively automatic systems,
  9. You have the right to request the elimination of damages in case you suffer damage due to the unlawful processing.

In accordance with the first paragraph of Article 13 of the LPPD, you can send your request regarding the use of your aforementioned rights to our Company in writing or through the methods determined by the Personal Data Protection Board.

To use your above-mentioned rights, you can personally submit your request petition with the necessary information identifying your identity, through a notary or by sending it via secure electronic signature to [address].

In accordance with the Law on the Protection of Personal Data (“LPPD”), our company ECORDING ENVIRONMENTAL TECHNOLOGIES ENG. TRADE LTD. (“ECORDING”), with its registered address at Çarşı Mah. İnönü Cad. Belediye Başkanlığı No: 32/403 Merkez/Artvin, registered with the Artvin Tax Office under tax number 3240871458, and registered with the Chamber of Commerce under registration number ….., operating the website ECORDING.org, is the Data Controller.

As ECORDING, we prioritize the confidentiality and security of your personal data. In this context, we provide the following explanations to fulfill our obligation to inform arising from Article 10 of the Law No. 6698 on the Protection of Personal Data (“Law No. 6698”) for the valuable mobile application users and third-party visitors using our website.

Our aim is to inform you, the data subjects, as clearly as possible about the identity of the data controller, the methods of collection of personal data, purposes and methods of processing, legal reasons for the collection of data, to whom and for what purposes personal data may be transferred, whether your personal data is transferred abroad, and how ECORDING and/or ECORDINGAPP store and protect personal data, as well as the rights of data subjects. The ECORDING and/or ECORDINGAPP Privacy Notice addresses the personal data we collect, who has access to this personal data, the purposes for which this personal data will be used, and to which third parties abroad the data may be transferred, as well as your additional rights and obligations regarding the use of our applications and services.

In the scope of the purposes of this Privacy Notice regarding the Processing of Personal Data,

  • “Personal Data” refers to information related to an identified or identifiable natural person; and
  • “Processing” refers to operations such as collection, withdrawal of consent, access, use, sharing, storage, and destruction related to Personal Data.

This privacy notice is applicable to individuals who use the ‘ECORDING App’ mobile application, visit the ecording.org website and its subdomains, wish to obtain information about ECORDING’s and/or ECORDINGAPP’s products and services, real persons who use the website and call center to make requests, suggestions, or complaints regarding products and services, customers and prospective customers, suppliers, job applicants, former employees, subcontractors and subcontractor employees, employees of ECORDING and/or ECORDINGAPP, business partners, or corporate customer representatives whose personal data is processed by our company.

  1. What is the legal basis for ECORDING App to collect personal data?

In order to protect the privacy of individuals and to prevent the disclosure of data that may be harmful if it falls into the hands of third parties, the Law No. 6698 on the Protection of Personal Data, published in the Official Gazette dated 07.04.2016 and numbered 29677, entered into force. As the data controller, ECORDING ENVIRONMENTAL TECHNOLOGIES ENG. TRADE LTD. (“ECORDING” or the “Company”) is committed to processing and protecting your personal data belonging to our mobile ‘ECORDINGAPP’ application users in compliance with Law No. 6698 on the Protection of Personal Data and secondary regulations (“DP legislation”).

With this Privacy Notice, we would like to inform you about the processing activities of ECORDING and/or ECORDINGAPP related to your personal data. The main purpose of data processing is to ensure the autonomous verification of tasks performed using scientific methods. Autonomous verification is the approval of tasks based on an objective evaluation result without being dependent on a person. The main purpose of subjecting tasks to approval is to make the reduced carbon footprint measurable after the tasks are completed. Additionally, the verification method constructed without the human factor in the decision-making process aims to ensure fairness among users.

ECORDING/ECORDINGAPP takes maximum care to ensure the prevention of unauthorized access to and preservation of personal data collected in accordance with Law No. 6698 on the Protection of Personal Data and related secondary regulations, within the framework of the principle of respect for the privacy of private life and fundamental rights and freedoms, by taking all necessary technical and administrative measures.

  1. For what purposes does ECORDING and/or ECORDINGAPP Process and Use Personal Data?

In accordance with the legislation and to the extent permitted, ECORDING and/or ECORDINGAPP may record, store, update, disclose to third parties, transfer, classify, and process your personal information.

The purposes of processing and using your personal data are as follows:

  • To provide products and services,
  • To verify the identity information of the transaction initiator,
  • To record contact information such as addresses and other necessary information for communication,
  • To conduct commercial relations,
  • To enhance service quality,
  • To fulfill obligations arising from contracts,
  • To establish communication with data subjects,
  • To organize all records and documents based on processing, whether electronic (internet/mobile, etc.) or paper-based,
  • To enable you and/or the organizations you represent to benefit from the products and services offered by ECORDING and/or ECORDINGAPP, to determine and implement the commercial and business strategies of our Company, including but not limited to conducting marketing activities, performing business development and planning activities, and providing necessary services, including, but not limited to, designing periodic (daily, weekly, monthly, etc.) campaign activities, special advertising, campaigns, and other promotional-sponsorship activities for user profiles, providing data to third-party company users who create subscriptions by purchasing in the mobile application within this context, using contents sent by users anonymously in scientific studies, and conducting user ‘classification’ studies based on the data obtained, conducting surveys and telemarketing activities, performing data mining and statistical analysis,
  • To carry out administrative operations related to communication conducted by ECORDING/ECORDINGAPP,
  • To establish business partner/customer/supplier (authorized or employees) relationships,
  • To ensure compliance with contractual requirements and financial reconciliation regarding products and services offered jointly with our business partners, suppliers, or other third parties,
  • To execute the human resources policies of ECORDING,
  • To be processed for using ECORDING’s website and/or participating in training, seminars, or events organized by ECORDING,
  • To evaluate user complaints and suggestions regarding our products and services,
  • To engage in product sales, marketing, and informative activities,
  • To acquire customers, conduct risk analysis, and make improvements based on customer and consumer needs,
  • To carry out risk analysis, internal auditing, reporting, market research, and profiling studies,
  • To evaluate job applications and manage human resources processes and employment policies in this context,
  • To send newsletters and invitations,
  • To ensure the physical security and supervision of ECORDING’s workplaces and factories,
  • To fulfill our obligations arising from the Personal Data Protection Law (KVKK) and exercise our rights arising from legislation,
  • To provide the service offered within the scope of the application;
  • When the application is used, personal data is used to provide services to the User. For example, when the Application is used to monitor user-generated content, tasks, activities, or the status/features of location, these personal data are collected and stored to be examined within the Application. The task and activity data within the application may include data such as the user’s inputted data or uploaded content along with location data and motion data collected by the device used during these tasks. These task and activity data may be visible to the Verifier in the application for the execution of the service in the application, and at the same time, they may be shared anonymously with third parties who subscribe to paid services within the scope of Subscription Packages of the application, as part of the application’s functionality.
  • Additional data may need to be provided or additional consent may need to be given for certain data to be used in specific ways to use certain features in the application. For example, for the delivery of rewards, purchases, etc., within the ECORDINGAPP MARKET, address and email address may be requested, and feedback may be provided to Users reaching ECORDING via the “Contact Us” section, using location information obtained as a feature of the application to perform tasks, etc.
  • Ensuring the Execution, Development, and Maintenance of the Service:
  • Your personal data is used by us to manage the Application, execute the service, enhance your user experience, and diagnose technical and service issues.
  • Protection of Rights of Ourselves and Third Parties:
  • Your personal data may also be used to detect and prevent fraud, abuse, illegal use, and violations related to the Terms of Use of ECORDINGAPP.
  • Other Purposes:
  • If your personal data will be used in other ways, specific notification will be provided during the collection of this data, and your consent will be obtained when necessary.
  1. Is Your Personal Data Transferred to Third Parties?

The sharing of your personal data with third parties occurs within the framework of the explicit consent of the data subjects, and as a general rule, personal data is not transferred to third parties without the consent of the data subjects. However, personal data is shared with courts and other public institutions solely due to our legal obligations and to the extent required by them.

Your personal data may be shared with Ecording Environment Technologies LTD. and/or ECORDINGAPP (including all affiliated companies, subsidiaries, joint ventures, and all their branches and offices), program partner institutions and organizations with which we collaborate to conduct our activities, and companies with which we work within the scope of various marketing activities to provide you with better service and ensure customer satisfaction, as well as other domestic/international third parties and relevant business partners, in accordance with your explicit consent or legal provisions. Necessary security measures are taken when sharing your personal data.

In addition to the Personal Data listed in the table above, sharing any other data with ECORDING/ECORDINGAPP and/or business partners/suppliers, or uploading data to ECORDING’s applications, implies that you voluntarily make these data publicly available. ECORDING/ECORDINGAPP and/or business partners/suppliers bear no responsibility for data made public by you. Furthermore, the results derived from the collection and analysis of your personal data may be shared in an anonymous manner with employers and/or within the scope of academic studies (e.g., thesis, etc.) to be conducted by students, faculty members, etc. However, during this transfer, none of your personal data is transferred in a manner that can be associated with you.

Additionally, 

  • Your Personal Data is shared with third-party providers of information technology services, including call centers utilized by ECORDING and/or ECORDINGAPP to fulfill the purposes stated herein, as well as suppliers and ECORDING/ECORDINGAPP employees who provide services to you. Such sharing is carried out in accordance with Article 8/2 (a) of the Law by reference to Article 5/2 (c) and (ç), as it is necessary for the performance of the contract and to fulfill ECORDING/ECORDINGAPP’s legal obligations.
  • In the event of legal disputes, your Personal Data may be transferred to law firms and lawyers for ECORDING/ECORDINGAPP to exercise and protect its rights, in accordance with Article 8/2(a) by reference to Article 5/2 (e) of the Law.
  • Under certain circumstances, your data may be disclosed to law enforcement and security forces, judicial authorities, and relevant public institutions and organizations, as required by law and legal obligations, in accordance with Article 8/2 (a) by reference to Article 5/2 (a) of the Law.

Information about the third parties and/or categories of third parties to whom your data is disclosed is always available for your information and review.

  1. What methods does ECORDINGAPP use to collect personal data?

The relationship between the data subject and ECORDING and/or ECORDINGAPP, the types and nature of which vary depending on the communication channels used and the stated purpose information, can be diversified and differentiated.

As the data controller on behalf of ECORDING and/or ECORDINGAPP, within the framework of our legal obligations arising from the Law on Protection of Personal Data (LPPD) and relevant legislation, personal data, including special categories of personal data, is collected through verbal, written, or electronic methods based on explicit consent, as well as legal grounds arising from legislation, contracts, requests, commercial customs, and principles of fairness.

In this context, your personal data may be collected by real or legal persons acting as data processors on behalf of ECORDING and/or ECORDINGAPP, including but not limited to, the following methods:

  • Electronic or physical completion of the User Agreement/membership form,
  • Social networks used for membership or login to our application or websites,
  • Contact forms filled out to communicate with us, located on our application, websites, or third-party websites,
  • Online shopping applications directed from our application, ECORDINGAPP Market, or our websites, cookies used to recognize you, mobile applications,
  • Various contracts signed with our company ‘ECORDING’ and electronic mails, faxes, and letters sent to our company and/or ECORDINGAPP,
  • Third-party companies supporting us during any stage of the membership program process,
  • Our employees and customer service channels,
  • Social media channels and the use of search engines like Google,
  • User agreements and other contracts, campaigns, applications, forms, offers,
  • Data from all branches, if any, within ECORDING,
  • Information obtained from participants attending activities such as fairs, events, market research conducted by ECORDING and/or ECORDINGAPP, as well as information obtained from press organs, websites of local government members, blogs owned by ECORDING and/or ECORDINGAPP, applications and websites used for contests, surveys, games, campaigns, and similar purposes,
  • Information submitted by employers to enable the performance of the contract,
  • Directly provided information by you to ECORDING and/or ECORDINGAPP,
  • Data collected via third-party applications such as social media accounts for which you have granted access permission to ECORDING and/or ECORDINGAPP.
  1. What Rights Does the Data Subject Have under the LPPD?

Under Article 11 of Law No. 6698, you can exercise the following rights regarding your personal data by applying to ECORDING / ECORDINGAPP

  • Learning whether personal data has been processed,
  • Requesting information if personal data has been processed,
  • Learning the purpose of processing personal data and whether they are used appropriately for their purpose,
  • Knowing the third parties to whom personal data are transferred at home or abroad,
  • Requesting correction of personal data if it is incomplete or incorrectly processed,
  • Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law on Protection of Personal Data,
  • Requesting notification of the correction, deletion, or destruction of personal data to third parties in case of incomplete or incorrect processing or upon the request for deletion,
  • Objecting to the occurrence of a result against the individual by analyzing the processed data exclusively through automated systems,
  • Demanding compensation for damages in case personal data is processed unlawfully and causes damages.

In this context, requests submitted to ECORDING and/or ECORDINGAPP will be finalized free of charge within thirty days at the latest. In accordance with Article 13/1 of the LPPD, you can submit your request to use your rights mentioned above to our Company in writing and with a wet signature, or through other methods determined by the Personal Data Protection Board. 

You can send your handwritten signed petition or Application Form to the address ‘Çarşı Mah. İnönü Cad. Belediye Başkanlığı No: 32/403 Merkez/Artvin’ through a notary or deliver it in person, send an email to the address ‘[email protected]’ with your registered and known email address and identity information, send it through a notary or other methods determined by the Personal Data Protection Board, or send it securely electronically signed to the address [email protected]

Our company will conclude the application requests in accordance with Article 13 of the Law on Protection of Personal Data within thirty (30) days at the latest. If the process requires a fee, the tariff determined by the Personal Data Protection Board will be applied. In case your request is rejected, the reason(s) for rejection will be stated in our response.

Your personal data will be deleted, destroyed, or anonymized in accordance with the LPPD legislation and our Company’s Personal Data Retention and Destruction Policy when the necessary time expires or the purpose of processing is fulfilled.

In case of any attack on ECORDING’s servers and/or other systems resulting in damage to your personal data and/or being obtained/disclosed by third parties, our Company will immediately inform you and the Personal Data Protection Board.

This Information Notice may be updated to comply with changing conditions and legal regulations. You can follow the updates via our mobile application.
